The parties or a mediation service select a third party ”mediator” in the alternative dispute resolution (ADR) process of mediation. The mediator meets with the parties, both together and separately. Using communication and negotiation in a non-coercive and unbiased manner, the mediator attempts to encourage the disputing parties to come to their own voluntary settlement.
The benefits to mediation are that it is shorter, less costly, and less formal than a lengthy court lawsuit. Mediation can be highly successful.
